Scope

This Refund Policy applies to AYCC Self-Hosted software (installed on the Customer’s infrastructure: on-premises or Customer cloud) and to any professional services provided by AYCC (e.g., installation, setup, consulting, custom development). AYCC primarily operates B2B, but does not exclude consumer purchases. Where the Customer is a consumer, any mandatory statutory rights under applicable law remain unaffected.

Free trial

If a free trial is available (e.g., 15 days), no refund is due during the trial period because no charge is due, unless otherwise agreed in the commercial terms applicable to the specific Customer.

General rule: no refunds (B2B)

Unless otherwise agreed in writing with the specific buyer, AYCC does not provide refunds.
Any refund, if granted, is exceptional, fully discretionary, handled case-by-case, and does not create any precedent.

Supply trigger and start of installation

Because AYCC does not issue license/activation keys and the Product is installed on the Customer’s server, “supply” is deemed to start when either:

  • AYCC begins installation/provisioning activities on the Customer’s server; or
  • the Product becomes operational or accessible on the Customer’s server (even internally).

Once supply has started, no refund is due, except:

  • where AYCC agrees otherwise in writing for a specific case; or
  • where mandatory consumer rights apply under applicable law.

Professional services and custom development

Professional services (installation, setup, consulting) and custom development:

  • are non-refundable once performed (in whole or in part), unless otherwise agreed in writing;
  • may be governed by separate written terms agreed between the parties.

Non-refundable items (unless mandatory law requires otherwise)

To the extent permitted by applicable law, the following are non-refundable:

  • taxes/VAT already remitted and non-recoverable;
  • bank/payment processing fees;
  • professional services/hours already delivered;
  • custom development already started or delivered;
  • third-party costs incurred on the Customer’s behalf.

Consumers: mandatory rights and early performance (where applicable)

If the Customer is a consumer, mandatory statutory rights may apply (for example, in some jurisdictions a withdrawal right for distance contracts), with potential exceptions for digital content/services where the consumer requests performance to begin before the end of the withdrawal period and acknowledges the consequences, where permitted by applicable law. Nothing in this Policy is intended to limit any mandatory consumer rights relating to non-supply or non-excludable defects/remedies under applicable law.

How to request a refund (exceptional cases only)

There is no standard refund procedure because refunds are not offered as a standard measure. If the Customer believes an exceptional case exists, they may contact info@allyoucancloud.com and include:

  • invoice/order holder details;
  • invoice/order reference;
  • reason for the request;
  • installation/supply status (started/completed);
  • confirmation of cessation of use and willingness to uninstall/disable the Product if requested.

AYCC will review and respond within a reasonable timeframe. Any refund method/timing (if granted) will be agreed in writing case-by-case.

Cessation of use and uninstall

If a refund (or equivalent settlement) is granted, the Customer must stop using the Product and, upon request, uninstall or render the installation unusable, except where required by law or for non-operational backups.

Chargebacks and disputes

In case of a chargeback or payment dispute, AYCC may suspend updates, support, and/or functionality until the dispute is resolved, without prejudice to AYCC’s rights to protect its interests and seek payment of any outstanding amounts.

Bulgarian law. Jurisdiction: Varna Regional Court.
